Website, Rental and Packing Support Agreement - Customer Copy

1. About this agreement

1.1 Who we are. In these Terms and Conditions (the "Terms"), "Bin Here Moved That," "we," "us," and "our" mean Four Square Design & Build Inc., carrying on business as Bin Here Moved That.

1.3 What forms the agreement. These Terms, your order-review screen, order confirmation, and the fee schedule disclosed before checkout form the agreement for your booking. If an order-specific term conflicts with these Terms, the order-specific term controls for that booking. Your booking is formed when we send an order confirmation.

1.4 Eligibility and authority. You must be at least 18 years old and legally capable of entering into a contract. If you book for another person, a business, or a property you do not own, you confirm that you have authority to do so and permission for delivery, pickup, and any confirmed in-home packing support at that property.

1.5 Consumer rights. Nothing in these Terms limits or waives a right or remedy that cannot lawfully be limited or waived under the Consumer Protection Act, 2002 or other applicable law.

2. Services, pricing, and payment

2.1 Our services. We rent reusable moving bins and related equipment such as dollies, moving blankets, hand trucks, or carts. We also sell packing supplies and move-ready kits. When separately selected and confirmed, we provide time-based packing support as described in section 10. We do not load or unload vehicles, transport or store customer belongings, or provide moving, cleaning, junk-removal, personal-care, or medical services unless a separate written agreement expressly states otherwise.

2.2 Order details. The package, quantities, add-ons, rental dates, delivery and pickup addresses, packing-support date and session length, delivery method, and service area are shown during checkout and in your order confirmation, as applicable.

2.3 Prices and currency. All prices are in Canadian dollars. Checkout will show the itemized package price, packing-support charge, add-ons, delivery or zone charges, discounts, HST, and total payable. A mandatory non-government charge will not be added after you accept the order unless it arises from a later request, an agreed change, or an event covered by the additional-charge provisions in these Terms.

2.4 Payment. Unless your order confirmation says otherwise, full payment is due when you book. We accept the payment methods shown at checkout. A booking remains subject to availability until we send the order confirmation.

2.5 Pricing or availability error. If we discover a clear pricing, inventory, or scheduling error before service begins, we will contact you promptly. You may accept a corrected order or cancel the affected service for a full refund. We will not charge a corrected amount without your agreement.

2.6 Packing-support eligibility. Packing support is available only as an add-on to a confirmed Bin Here Moved That reusable moving-bin rental. If the required bin rental is cancelled, the packing-support booking is also cancelled unless we agree otherwise in writing. The applicable refund is determined under section 7.

3. Rental period and ownership

3.1 Standard rental period. Unless the order confirmation states otherwise, the rental period is seven consecutive days. It begins when the equipment is actually delivered and ends on the scheduled pickup date. If we deliver later than agreed, the pickup date moves by the same amount unless we agree with you on another date.

3.2 Ownership. All rental equipment remains our property. You receive only a temporary right to use it for the confirmed rental period. You must not sell, lend, sub-rent, pledge, alter, conceal, or move the equipment to another address without our written approval.

3.3 Our delayed pickup. We may collect the equipment up to one business day after the scheduled pickup because of routing, traffic, weather, or operational conditions. You will not be charged for that additional time when the delay is ours, but you must continue to keep the equipment secure and accessible.

4. Delivery, access, and property conditions

4.1 Accurate information. You are responsible for providing complete and accurate addresses, contact information, requested dates, access instructions, parking restrictions, and known conditions that could affect safe delivery, pickup, or packing support.

4.2 Delivery and pickup location. Delivery and pickup are to a reasonably accessible, safe, legal, ground-level location such as a driveway, garage, loading area, or building entrance. Indoor carrying, stairs, elevators, long carries, or special handling are not included unless stated in your order confirmation.

4.3 Safe access. You must ensure that the property has sufficient clearance and lawful parking or loading access and is free from undisclosed hazards, fragile surfaces, low branches or wires, unmarked irrigation, uncontrolled animals, ice, snow, and other conditions that could reasonably create risk. Tell us in advance about stairs, elevators, parking limits, accessibility needs, or other special conditions. We may pause or refuse service when it cannot be completed safely or lawfully.

4.4 Contactless delivery. If you authorize us to leave equipment without you present, responsibility for the equipment begins when it is placed at the agreed location. We may take time-stamped photographs limited to documenting delivery, pickup, access, equipment count, and condition. These photographs are not used for marketing without separate permission.

4.5 Failed access. If we cannot complete a scheduled delivery, pickup, or packing session because the address, access, permissions, site readiness, or required contact is unavailable or inaccurate, the applicable cancellation, additional-trip, or overdue provisions may apply. No charge applies when the failure is caused by us.

4.6 Service windows. Delivery and pickup times are estimates unless we expressly guarantee a time in writing. A packing-support appointment begins at the confirmed start time, subject to a reasonable arrival window disclosed in the order confirmation. We will use reasonable efforts to notify you of a material delay.

5. Safe use and care of rental equipment

5.1 Inspection. Please inspect the equipment promptly after delivery and report a missing item, material defect, or pre-existing damage within 24 hours, with a photograph when reasonably possible. A prompt report helps us correct the order and prevents responsibility for pre-existing damage.

5.2 Permitted use. Use the equipment only for ordinary household or office moving and packing purposes and in accordance with any instructions we provide.

5.3 Weight and packing. Do not load more than 50 lb (23 kg) per bin. Distribute weight evenly, do not overfill a bin, and ensure the attached lid closes completely without force. Do not use bins or dollies as steps, seats, platforms, toys, or transport for people or animals.

5.4 Care. Keep the equipment secure, reasonably clean, and protected from avoidable damage, extreme heat, open flame, standing water, pests, theft, and unauthorized use. Use only the designated dry-erase label area and suitable dry-erase markers. Do not drill, cut, paint, permanently mark, remove identification, or attach permanent labels or adhesives.

5.5 Prohibited contents. Do not place in or on the equipment any illegal item; weapon or ammunition; fuel, propane, fireworks, explosive, flammable or corrosive material; compressed gas; pesticide; hazardous chemical; medical or biological waste; leaking liquid; wet paint; hot material; live animal; perishable food likely to spoil; or any substance likely to stain, contaminate, create odour, attract pests, or endanger a person, property, or the equipment.

5.6 No relocation without approval. The equipment must remain at the confirmed address unless your order expressly allows you to move it. If approval is given, you remain responsible for using an appropriate vehicle, securing the load, and complying with all laws and manufacturer instructions.

6. Pickup, extensions, and overdue equipment

6.1 Pickup readiness. By the scheduled pickup time, all rental equipment must be empty, reasonably clean, dry, stacked or arranged as instructed, and accessible at the agreed ground-level location. Remove all personal property and waste.

6.2 Extension requests. Request an extension at least 72 hours before scheduled pickup. An extension is not confirmed until we approve it in writing and receive any required payment. Extensions depend on inventory and route availability.

6.3 Extension price. An approved extension is charged at 50% of the original package price for each additional seven-day period, plus applicable tax, unless your order confirmation states a different amount.

6.4 Overdue or inaccessible equipment. If equipment is not ready or accessible at pickup and no extension has been approved, the overdue charge in Schedule A applies for each commenced additional seven-day period. If a pickup attempt fails because the equipment is not ready or accessible, the address or access information is inaccurate, or required permission or contact is unavailable, a $50 failed-pickup fee plus HST applies for each failed attempt. No overdue or failed-pickup charge applies when the delay or failure is caused by us.

6.5 Final demand and missing status. We may send a written final demand stating the equipment to be returned and the return or recovery instructions. Equipment that is not returned within five calendar days after the final demand is sent to the most recent email or contact address you provided will be considered missing, and the applicable replacement charge in Schedule A may be invoiced or processed in accordance with section 11.5. Overdue charges stop accruing when the equipment is considered missing and the replacement charge is applied.

6.6 Access for recovery. You must cooperate with reasonable recovery arrangements and provide safe, lawful access to the equipment at an agreed time. We will not enter a dwelling, garage, fenced or secured area, or any other non-public part of the property without permission or other lawful authority. Your duty to return the equipment and your responsibility for applicable overdue, failed-pickup, damage, or replacement charges continue if access is refused or unavailable.

7. Customer cancellations and rescheduling

7.1 How to cancel. Contact us by telephone or at the customer-service email listed in section 1.2 and clearly identify the booking or service you wish to cancel. We will confirm the cancellation in writing.

7.2 Rental cancellation policy. Unless a more favourable policy appears in your order confirmation: (a) cancellation at least 72 hours before scheduled delivery receives a full refund; (b) cancellation less than 72 hours before delivery but before dispatch receives a 75% refund; and (c) cancellation after the delivery vehicle has been dispatched or delivery has been attempted receives a 50% refund.

7.3 Packing-support cancellation policy. For the packing-support portion of an order: (a) cancellation at least 72 hours before the scheduled session receives a full refund; (b) cancellation less than 72 hours before the session but before we travel to the property receives a 75% refund; and (c) cancellation after we have begun travelling to the property, or a failed appointment caused by unavailable access, an absent required adult, or unsafe undisclosed conditions, receives a 50% refund. Rental and packing-support portions are assessed separately when practical.

7.4 Rescheduling. You may request one delivery-date or packing-session change without an administrative fee if you contact us at least 72 hours before the applicable date. The replacement date is subject to availability. Any price change will be disclosed and requires your agreement before confirmation.

7.5 Statutory rights preserved. These voluntary policies are in addition to any cancellation or refund right under applicable consumer-protection law, including rights arising from required disclosures, delivery of a written agreement, or late delivery or performance.

8. Cancellation or changes by us

8.1 Safety, availability, and operational issues. We may reschedule, modify, pause, or cancel a booking if equipment or staff is unavailable, a site is unsafe or unlawful, weather or road conditions make service unsafe, information provided for the booking is materially inaccurate, the requested work falls outside the confirmed scope, or an event beyond our reasonable control prevents performance.

8.2 Your options. If we cannot provide the confirmed service, you may accept a reasonable alternative date or service, or receive a refund for the unperformed portion. If we cancel before performance for a reason not caused by you, you receive a full refund for the affected service.

9. Packing supplies and other goods

9.1 Sales. Packing paper, honeycomb wrap, stretch wrap, tape, zip ties, mattress bags, labels, and other consumables are sold, not rented, unless the order says otherwise.

9.2 Materials for packing support. Unless the order confirmation says materials are included, packing materials and supplies are separate from the packing-support fee. You must purchase or provide enough suitable materials for the requested work. We may recommend additional materials, but we will not add a charge without your approval.

9.3 Voluntary return policy. Unless marked final sale before purchase, an unopened, unused, resaleable consumable may be returned with proof of purchase at scheduled equipment pickup or within 14 days after delivery, whichever occurs first. Opened, used, custom, clearance, hygiene-sensitive, or damaged goods are not returnable unless defective. This policy does not limit any statutory right.

10. Packing support

10.1 Nature of service. Packing support is a time-based helping service performed within the confirmed session length. We will use reasonable care to organize, wrap, place, and label ordinary household or office belongings as directed. We do not guarantee that a particular room, quantity, or entire property will be completed within the booked time.

10.2 Customer direction and decisions. You remain responsible for deciding what will be packed, kept, moved, donated, discarded, or left behind and for giving clear instructions. We do not appraise property, decide ownership, resolve disputes among occupants, or dispose of an item without your direction and any required authorization.

10.3 Required adult presence. The customer or an authorized adult who is at least 18 years old must remain at the property throughout the packing session, be available to answer questions and make decisions, and have authority over the belongings and premises. Time lost because the required person is absent or unavailable counts toward the session unless the delay is caused by us.

10.4 Safe working conditions. You must provide safe, lawful, sanitary, adequately lit, and reasonably climate-controlled working conditions, access to necessary rooms, and clear walking paths. Secure pets and disclose known hazards, pests, mould, smoke exposure, aggressive persons, biohazards, needles, structural problems, or other conditions that may create risk. We may decline, pause, or end work that cannot be performed safely or respectfully. Any refund for unperformed time will consider whether the condition was disclosed and whether it was within your control, subject to applicable law.

10.5 Packing-only boundary. Unless expressly included in the order confirmation, packing support does not include moving or lifting furniture or appliances; loading or unloading vehicles; transporting or storing belongings; mounting or removing wall fixtures; electrical, plumbing, repair, or trade work; furniture disassembly or reassembly; cleaning; junk removal; working at unsafe heights; or personal-care, medical, or mobility assistance. We may also decline any lift, reach, or handling task that we reasonably consider unsafe.

10.6 Items we will not pack. You must personally secure and pack cash, jewellery, securities, negotiable instruments, passports, identity documents, keys, prescription medication, confidential records, irreplaceable or unusually valuable items, and items of exceptional sentimental value. We will not knowingly pack prohibited contents listed in section 5.5, illegal items, firearms, weapons, ammunition, hazardous materials, live plants or animals, perishable food likely to spoil, or any item we reasonably believe is unsafe. Tell us before work begins about fragile, high-value, antique, electronic, or specially insured items.

10.7 Fragile items and hidden conditions. We will use reasonable care with items we agree to pack. You are responsible for identifying unusual fragility, pre-existing damage, missing parts, hidden defects, special manufacturer instructions, and any item requiring specialist handling. We may decline an item or recommend original packaging or a specialist. Nothing in this section excludes responsibility for damage caused by our failure to use reasonable care.

10.8 Materials and customer choices. Our work depends on suitable bins, wrapping, cushioning, dividers, and other materials being available. If you decline recommended materials or direct us to use materials that are visibly inadequate, we may decline to pack the affected item. If we agree to proceed, responsibility for resulting loss will be allocated according to each party's acts or omissions and applicable law.

10.9 Session time and additional work. The session begins at the confirmed start time when access and the required adult are available and ends after the booked service time. Setup, customer instructions, ordinary room-to-room movement, and packing-related cleanup are part of the session. Additional time or a further session depends on availability and must be approved at the price disclosed before the extra work begins.

10.10 No inventory or condition report unless confirmed. Packing support does not include an itemized inventory, valuation, photography, or formal condition report unless the order confirmation expressly includes it. You should review labels and the packing area before the session ends and tell us promptly about an apparent issue.

10.11 After packing. You are responsible for keeping packed bins upright, within the 50-lb limit, securely closed, protected from weather and unauthorized access, and handled according to our instructions. Movers, carriers, storage providers, family members, and other third parties are not under our control. Our packing-support fee does not include transport, storage, or insurance for your belongings.

11. Loss, damage, cleaning, and additional charges

11.1 Responsibility period. You are responsible for reasonable care of rental equipment from completed delivery until we recover it, except for normal wear, pre-existing defects, and loss or damage caused by our act or omission.

11.2 Normal wear. Normal wear includes minor scuffs and ordinary cosmetic marks from proper use. You are not charged for normal wear.

11.3 Chargeable conditions. A charge may apply for missing equipment; a broken lid, wheel, handle, axle, or frame; permanent writing or adhesive; avoidable cracking, warping, burning, staining, odour, contamination, or pest exposure; prohibited contents; excessive soil or residue; or damage caused by overloading, misuse, unauthorized relocation, theft, vandalism, or failure to secure the equipment.

11.4 How charges are determined. Charges will not exceed the applicable amount in Schedule A or, for an item not listed, the reasonable repair, cleaning, decontamination, or replacement cost disclosed in the order when reasonably determinable. For a repairable item, the charge is the lower of reasonable repair cost and the listed replacement charge.

11.5 Notice and card charges. We will send an itemized notice and available supporting information, such as photographs or an equipment count. Except for an undisputed amount or where immediate action is legally required, you will have 48 hours to raise a question before we charge a stored payment method that you separately authorized for post-rental charges. If no such authorization exists, we will issue an invoice payable within seven days.

11.6 Return after a replacement charge. If missing equipment is returned after a replacement charge has been paid, we will refund the replacement charge for the returned equipment. You will instead be charged only for the overdue rental time actually used, calculated in commenced seven-day periods under Schedule A, plus any applicable $50 failed-pickup fee and HST. The refund will be reduced by those amounts and by any separately chargeable damage, cleaning, or missing-equipment amount that remains applicable. No refund is due for equipment that is not returned.

11.7 Collections and lawful recovery. If equipment has not been returned and an amount owing remains unpaid for 30 days after its invoice due date, we may refer the account to a registered collection agency or pursue another lawful recovery method. We may seek reasonable court costs or collection costs only to the extent permitted by law or awarded by a court. Referral to collections does not transfer ownership of our equipment to you or remove your obligation to return it.

11.8 Theft. Tell us promptly if rental equipment is stolen and reasonably cooperate with a police or insurance report. A police report does not automatically remove responsibility, but we will consider the circumstances and any recovered equipment when determining the amount due.

12. Customer belongings and insurance

12.1 Your belongings. Except for our limited handling during a confirmed packing-support session, your belongings remain in your possession and control. We do not load, transport, store, monitor, or insure them. You are responsible for selecting suitable materials, identifying excluded or specialist items, protecting valuables, maintaining any desired inventory, and arranging appropriate insurance.

12.2 Empty pickup. Rental bins must be empty at pickup. If personal property remains, we may refuse pickup or follow your reasonable written instructions at your cost. We will not knowingly dispose of property without reasonable notice unless safety or law requires immediate action.

12.3 Insurance. Consider whether your home, tenant, commercial, automobile, storage, or moving insurance covers your belongings and use of rental equipment. Rental and packing-support prices do not include insurance for your belongings.

13. Our responsibility and limits

13.1 Reasonable care. We will use reasonable care in providing the confirmed delivery, pickup, rental, and packing-support services and in maintaining our rental equipment.

13.2 Report concerns. Please report personal injury, property damage, damaged belongings, an equipment defect, a service issue, or an incorrect order promptly after discovery and, where reasonably possible, before the affected item is moved, repaired, discarded, or unpacked further. A delayed report does not waive a legal right, but it may affect our ability to verify what occurred.

13.3 Excluded losses. To the extent permitted by law, we are not responsible for indirect, incidental, special, or consequential loss, including a missed move, missed closing, lost income, loss of use, or loss of electronic data, unless that loss cannot lawfully be excluded.

13.4 Matters outside our control. We are not responsible for loss caused by customer packing or instructions; undisclosed pre-existing damage or fragility; prohibited contents; inadequate materials the customer selected or insisted upon; overloading; misuse; unsafe or inaccurate site information; theft or vandalism not caused by us; ordinary shifting during transport; or acts of a mover, carrier, storage provider, occupant, or other third party outside our reasonable control. This clause does not apply to the extent a loss was caused by our act or omission.

13.5 Non-excludable liability. Nothing in these Terms excludes or limits liability for our negligence causing personal injury or physical property damage, gross negligence, wilful misconduct, fraud, or any liability or consumer right that cannot lawfully be excluded or limited.

14. Your responsibility to us

14.1 Misuse and third-party claims. You are responsible for reasonable losses, damages, fines, clean-up costs, and third-party claims caused by your breach of these Terms, prohibited contents, misuse of equipment, lack of authority over the property or belongings, or unsafe or unauthorized instructions, except to the extent caused by our act or omission.

14.2 Mitigation. Both you and we will take reasonable steps to reduce avoidable loss after learning of a problem.

15. Website use and intellectual property

15.1 Acceptable use. You may use our website for lawful personal or business booking purposes. Do not interfere with the website, attempt unauthorized access, introduce malicious code, scrape the website in a manner that burdens it, or use false information to make a booking.

15.2 Content ownership. Our name, logo, photographs, graphics, website design, and original written content are owned by or licensed to us and may not be copied or used commercially without permission, except as allowed by law.

15.3 Third-party services. Our website may use or link to third-party payment, mapping, scheduling, analytics, or social-media services. Their separate terms and privacy practices may apply to your use of those services.

16. Privacy and communications

16.1 Personal information. We collect, use, disclose, retain, and safeguard personal information in accordance with our Privacy Policy and applicable law. The Privacy Policy should be read with these Terms but does not reduce your rights.

16.2 Service communications. You agree that we may use the telephone number, email address, addresses, access details, and other information you provide to process payment, confirm and manage the booking, provide service updates, address safety or access issues, prevent fraud, and respond to questions or claims.

16.3 Marketing. We will seek any consent required by law before sending promotional electronic messages. A marketing choice is separate from communications reasonably necessary to complete your booking.

16.4 Interior privacy. We do not photograph the interior of a home or its contents for marketing without separate permission. We may document an incident, reported damage, unsafe condition, or disputed service issue when reasonably necessary and lawful, while taking reasonable steps to avoid collecting unrelated personal information.

17. Events beyond reasonable control

17.1 Force majeure. Neither party is responsible for delay caused by an event beyond reasonable control, such as severe weather, unsafe roads, wildfire, flood, public emergency, government order, labour disruption, utility or communications failure, illness, or unexpected vehicle breakdown, provided the affected party uses reasonable efforts to notify the other and reduce the delay.

17.2 Unperformed service. If such an event materially prevents us from providing the service within a reasonable time, you may accept a new date or cancel the unperformed portion for a refund.

18. Questions, complaints, and disputes

18.1 Contact us first. If you have a concern, contact us using section 1.2 and provide the order number, relevant dates, photographs or other available information, and a description of the issue. We will review the matter in good faith and aim to respond promptly.

18.2 Governing law. These Terms and each booking are governed by the laws of Ontario and the applicable federal laws of Canada. Any court proceeding may be brought in a court of competent jurisdiction in Ontario, subject to any mandatory consumer right to proceed elsewhere.

18.3 No mandatory arbitration. These Terms do not require a consumer to submit a dispute to mandatory arbitration or waive participation in a proceeding where such a requirement or waiver would be unenforceable under applicable law.

19. Changes and general terms

19.1 Changes. We may update these Terms for future bookings by posting a revised version with a new effective date. The version accepted when you book continues to govern that booking unless you and we agree to a change or the law requires otherwise.

19.2 Changes to an existing booking. A material change to dates, package, price, session length, scope, location, or another order term is effective only when confirmed in writing. We will disclose any price change before you agree.

19.3 Severability. If part of these Terms is found invalid or unenforceable, the remaining parts continue to apply to the extent permitted by law.

19.4 No waiver. A delay in enforcing a term does not waive it. A waiver applies only to the specific matter for which it is given.

19.5 Assignment and service providers. You may not transfer a booking without our written consent. We may use employees or qualified independent service providers for delivery, pickup, packing support, payment, scheduling, or support, while remaining responsible for our contractual obligations.

19.6 Electronic records. You agree to receive the order confirmation, these Terms, invoices, and booking notices electronically at the email address you provide, without limiting any right to request an accessible or printable copy.

Schedule A - Fee schedule

1. Approved extension: 50% of the original package price per additional seven-day period, plus HST.

2. Overdue equipment without an approved extension: 50% of the original package price per commenced seven-day period, plus HST.

3. Failed pickup caused by the customer: $50 per failed pickup attempt, plus HST.

4. Excess cleaning: $15 per bin plus HST; reasonable actual decontamination or replacement cost for hazardous contamination.

5. Missing or non-repairable moving bin: $40 per bin plus HST.

6. Missing or non-repairable dolly: $75 per dolly plus HST.

7. Missing or non-repairable moving blanket: $25 per blanket plus HST.

8. Missing or non-repairable hand truck or cart: $100 per item plus HST.

9. Repairable equipment: The lower of reasonable repair cost and the applicable replacement charge.

10. Parking, toll, or site-access cost: Actual amount only when disclosed in the order or later authorized by the customer.

11. Additional packing-support time: The rate disclosed to and accepted by the customer before the additional work begins, plus HST.

Customer assurance: No charge applies for normal wear, a pre-existing defect, our delayed pickup, or loss or damage caused by us. We will provide an itemized notice before a disputed post-rental charge is processed.
